Arkansas Family Law Attorney

If you are looking for a family law attorney, it is usually because either you or your spouse wants a divorce. The first thing you must understand about the divorce process is that Arkansas is a "no-fault" state, which means that if the other party wants to get a divorce, the state will grant one after 18 months of separation.

A divorce decree will cover the following issues:

  • Division of property (assets and liabilities)
  • Child custody (physical and legal or decision-making)
  • Visitation or parenting plan

A divorce may be uncontested or contested. If a divorce is uncontested, it is still a good idea to have an attorney to protect your interests.

At The Henry Firm, P.A., we believe in absolute integrity at all times. If opposing counsel (your spouse's attorney) is behaving in an unethical manner, we have no qualms about filing a motion to sanction the opposing counsel. We believe that we should all play by the same rules.

For any family law issue including divorce, division of property and child custody, please contact our Arkansas divorce attorney at 866-533-0553 or 501-859-6170, or send our firm an e-mail.

Little Rock Property Division Lawyer ∙ 50/50 May Not Be Equal

One common misconception for divorcing couples is that property is not necessarily divided down the middle. It is divided in an "equitable and fair" manner, which means that one person may get $100,000 of equity in the home (and take over the mortgage payments) while the other person keeps $100,000 in a retirement plan.

It is also important to keep in mind that it is not only assets that are divided, but also liabilities. If one spouse has more income earning ability, he or she may take more assets but also accept more liabilities. When it comes to division of property, everything is negotiable.

Divorce and Spousal Support

In Arkansas, there is no mandated rule for spousal support or alimony. It may be granted depending on the length of the marriage, on income disparity and on other factors. Our attorney can advise you on potential spousal support depending on the facts of your situation.
